Top Health, LLC. (“Top Health,” or “we,” “our,” or “us”) respects your privacy, and is committed to protecting it through our compliance with this policy. This Privacy Policy (our “Privacy Policy”) describes the types of information we may collect from you or that you may provide when you visit or use our website located here (our “Website”) or our Top Health mobile application (our “App”) and our practices for collecting, using, maintaining, protecting, and disclosing that information. For purposes of this Privacy Policy, our Website, App and all related services and functionalities we provide through them are referred to as our “Digital Services”.

- On our Digital Services including the Web app and Mobile app.

Health Information
Some information we collect constitutes or may constitute health and/or medical information, including protected health information (“PHI”) under the U.S. Health Insurance Portability and Accountability Act (“HIPAA”). Top Health is not a health care provider or health insurance plan or provider. Any health care services relating to or available through our Digital Services will be provided to your medical practitioners (“Providers”). Top Health is or may be a “business associate” (as defined under HIPAA) that provides services to and for Providers, Who are referred to as “covered entities” under HIPAA, and enters into business associate agreements with these covered entities. Top Health will use and disclose PHI only in accordance with the applicable business associate agreement(s), HIPAA and other applicable laws.
Security
We value your privacy and will always do our best to protect your private data. Top Health products are designed for use by healthcare organizations subject to the privacy and security standards defined by the U.S. Health Insurance Portability and Accountability Act (HIPAA) and the E.U. General Data Protection Regulation (GDPR) 2016/679. We provide physical, electronic, and procedural safeguards to protect information we process and maintain. For example, we limit access to this information to authorized employees and contractors (covered entities) who need to know that information in order to operate, develop, or improve services for the users.

We use your Data for various purposes described below, including to:
- Provide our Digital Services to you.
- Provide products and services to you.
- Notify you about changes
- Provide you with notices about your account.

OTP (One-Time Password) Authentication
OTP (One-Time Password) is a temporary code used for authentication. It is typically valid for a single use and has a short lifespan, providing an extra layer of security during the login processes.
When logging in to Top Health, we utilize OTP authentication to enhance security. Here's how it works:
- Request: Enter your registered phone number during login.
- OTP Generation: We generate a unique, temporary code and send it to your phone via SMS.
- Verification: Enter the OTP within a specified time frame.
- Authentication: If the OTP matches, you gain access to your account.
Log Files
Top Health follows a standard procedure of using log files. These files log visitors when they the use app. The information collected by log files includes internet protocol (IP) addresses, browser type, Internet Service Provider (ISP), date and time stamp, referring/exit pages, and possibly the number of clicks. These are not linked to any information that is personally identifiable. The purpose of the information is for analyzing trends, administering the app, tracking users' movement on the app, and gathering demographic information.
Our Advertising Partners
Currently we are not working with any advertising partners but some of our app features may be used by google services and may save cookies and web beacons. For easier access, we hyperlinked to their Privacy Policies below.

Third-party ad servers or ad networks use technologies like cookies, JavaScript, or Beacons that are used in their respective advertisements and links that appear on Top Health. They automatically receive your IP address when this occurs. Top Health does not share your “PHI” with any of the third-party ad servers and ad networks. Note that Top Health has no access to or control over these cookies that are used by third-party advertisers.

Children's Information
Another part of our priority is adding protection for children while using the internet. We encourage parents and guardians to observe, participate in, and/or monitor and guide their online activity. Top Health does not knowingly collect any Personally Identifiable Information from children under the age of 13. If you think that your child has provided this kind of information on our App, we strongly encourage you to contact us immediately and we will do our best efforts to promptly remove such information from our records.
Online Privacy Policy Only
This Privacy Policy applies only to our online activities and is valid for visitors to our App and is linked to our web application with regards to the information that they shared and/or collected in Top Health. This policy is not applicable to any information collected offline or via channels other than this app. Our Privacy Policy was created with the help of the App Privacy Policy Generator.
HealthKit Data
Our app uses Apple HealthKit to display health-related data locally on your device. We do not collect, store, or share any HealthKit data with our servers or third parties. All HealthKit data remains on your device and is not transmitted outside of the app.
Data Retention & Account Deletion
We retain user data as long as your account is active. When you delete or deactivate your account, all personal data is permanently removed from our active databases within 30 days.
How to Request Data Deletion or Data Access
Users can request account deletion directly within the mobile app by navigating to Profile > deactivate Account. Alternatively, you may request account deletion or request a copy of your stored data at any time by emailing us at support@tophealthapp.net.
